Disclosure of Material Facts
In applying for insurance all
material facts must be disclosed. Failure to do so could invalidate the policy.
A material fact is one which is likely to influence an insurer in the assessment
and acceptance of the application (e.g. any criminal conviction concerning
dishonesty). Material facts must be disclosed in relation to yourself and all
persons that are to be insured. If you are in doubt as to whether a fact is
material then it should be disclosed.
- It is an offence under the
Road Traffic Act to make any false statements or withhold any information to
obtain a Certificate of Motor Insurance.
- You should keep a record of
all information supplied for the purposes of entering into the insurance.
- Where you are required to
supply information relating to other persons who may be insured under the
contract that information must be factual and accurate to enable correct
assessment of risk by the insurer. You must have the consent of these
individuals to supply their personal details.
